I have noted the Terms and Conditions of Utilization and the Data Privacy Note for Gen Re Business School’s ILIAS e-learning platform and agree to the same.

Terms and Conditions of Utilization for Gen Re Business School’s ILIAS e-learning platform

1. Gen Re Business School ILIAS e-learning platform

These Terms and Conditions of Utilization shall apply to the ILIAS e-learning application provided by General Reinsurance AG’s Gen Re Business School (hereinafter: “Gen Re Business School”). Gen Re Business School shall furnish the participants with learning materials via the Internet for their exclusive personal utilization. 2. Registration and utilization

The prerequisite for the utilization of ILIAS shall constitute registration by Gen Re Business School. Gen Re Business School shall be entitled to refuse or cancel a registration without citing any reasons. Their registration shall oblige the users to accept these Terms and Conditions of Utilization.

In the event of false user information having been willfully provided upon registration or in the event of the deliberate failure to correct such false information user when data is modified Gen Re Business School shall be entitled to temporarily cancel or terminate your utilization authorization. Gen Re Business School shall reserve the right to automatically deregister users from ILIAS who have not accessed the ILIAS services for longer than one year. Users who infringe this utilization regulation shall be precluded from utilizing ILIAS.

3. Observance of copyrights

This Agreement shall oblige you to expressly acknowledge that ILIAS encompasses information, texts, software, images, videos, graphics, sounds and other materials which may be protected by copyrights, trademark rights or patent rights. You may utilize the ILIAS contents solely for your scheduled training purposes and only render such contents accessible to third parties insofar as Gen Re Business School has consented to the same in writing. Each and every unauthorized utilization of the learning materials may, as an infringement of the Copyright Act, result in an obligation to render compensation or prosecution under criminal law.

4. Rights and obligations of users

4.1 All users of ILIAS services shall bear full responsibility for their activities within the ILIAS application and the accompanying services.

4.2 The ILIAS utilization right shall not be transferable. The users shall ensure that their user IDs and their passwords are protected against unauthorized utilization. In the event that a user should notice or suspect that their access data has been misused they shall undertake to notify Gen Re Business School accordingly without delay. Gen Re Business School shall, in the event of an incidence of prejudice and given a misuse of access data, reserve the right to assert claims to compensation against the responsible user.

4.3 Users of the ILIAS services shall undertake to observe the prevailing statutory regulations and, in particular, to refrain from breaking any existing laws of the Federal Republic of Germany. Publishing, transmitting or disseminating any contents and/or comments which are illegal, especially comments of an insulting, violence-glorifying, discriminatory or extreme right-wing nature, shall be particularly prohibited. This shall also encompass contents which can be accessed by a link inserted by a user. In addition, the use of offensive contents and double-entendres shall be prohibited.

4.4 User activities which are aimed at rendering the ILIAS services inoperative, or at least at rendering their utilization more difficult, shall be prohibited and may be prosecuted under civil and criminal law. The internal ILIAS mail system may not be used for the purpose of sending advertisements, spam and/or non-seminar contents. Gen Re Business School shall assume no responsibility for the contents of or the possible non-observance of the Copyright Act in materials which it has not furnished.

5. Functional availability and guarantee

5.1 The ILIAS services shall be provided without assurances or guarantees. The range of services and the functional scope of ILIAS may, at any time, be modified or discontinued without prior notice. In addition, utilization and access to the range of services of Gen Re Business School’s ILIAS application may be restricted in terms of duration and scope. No legal entitlement to the permanent availability of the range of services of Gen Re Business School’s ILIAS application shall obtain. Nevertheless, Gen Re Business School shall endeavor to ensure that the full functional scope of ILIAS shall be available at all times and that downtimes shall be restricted to a minimum.

5.2 Gen Re Business School shall not guarantee the up-to-dateness, accuracy, completeness or quality of the furnished information or that the learning contents and program functions shall fulfil the requirements of the users.

5.3 References or links on third party websites shall not imply that Gen Re Business School adopts as its own the contents behind such references or links. Gen Re Business School shall have no influence on the contents behind such links. Therefore, these contents shall not constitute responsibility on the part of Gen Re Business School for the data or information which such contents encompass.

6. Liability

6.1 Claims to compensation against Gen Re Business School shall, irrespective of the legal grounds involved, particularly breach of contract and actionable tort, be precluded unless the incidences of prejudice at issue are predicated upon willful or grossly negligent breaches of obligations. The above liability exclusion shall likewise not apply to ordinarily negligent breaches of key contractual obligations (so-called cardinal obligations). What shall be understood by such cardinal obligations shall be obligations which must be fulfilled in order to facilitate contract performance in the first place and on whose observance the contracting party may therefore depend – conversely, a breach of such obligations shall entail the risk that the contractual purpose shall not be achieved.

6.2 Insofar as Gen Re Business School is liable in the case of ordinary negligence the scope of compensation claims shall be restricted to such incidences of prejudice whose occurrence was typical and foreseeable within the scope of the contractually agreed performance. In the event of a loss of data an incidence of prejudice which would have occurred given the regular and risk-commensurate production of back-up copies shall be deemed typical.

6.3 The above liability exclusions and restrictions shall not apply to claims under the Product Liability Act, claims given a breach of a contractually assumed guarantee and breaches of obligations which have resulted in harm to life, limb or health. The above liability exclusions and restrictions shall also apply to any third party compensation claims against Gen Re Business School in whose favor this Agreement exercises a protective effect. Insofar as liability on the part of Gen Re Business School is precluded or restricted this shall also apply to the personal liability of its associates, representatives and vicarious agents.

7. Modifications

Gen Re Business School shall be entitled to modify each and every section of this Agreement at any time. Such modification shall enter into force as soon as they are announced in ILIAS and accepted by the users. In the event that you should not consent to such modifications you must terminate your subscription to the ILIAS range of services. Your acceptance of such modifications and continued utilization of the ILIAS range of services shall oblige you to accept the modified Agreement and be bound by the provisions contained in the same.

Any alterations or additions to the provisions contained in these Terms and Conditions of Utilization shall not be valid unless they are in written or electronic form.

This Agreement can be viewed online under the “Terms and Conditions of Utilization and Data Privacy Note” menu item.

8. End of utilization authorization

The utilization authorization for ILIAS and the right to utilize the ILIAS materials shall expire upon the end of the client relationship with Gen Re Business School or the end of the assigned course.

The users may, at any time, terminate their right to utilize the ILIAS range of services without stating any reasons by notifying Gen Re Business School of their decision.

Gen Re Business School may, in part or in whole, suspend access to the ILIAS materials or terminate the utilization authorization in the event that such ILIAS materials should (by the users or other persons who have access to ILIAS under their user IDs and passwords) have been used in such a fashion which Gen Re Business School deems to constitute a breach of this Agreement or which otherwise results in an incidence of prejudice for Gen Re Business School.

This notice is designed to provide you with information about the processing of your personal data by General Reinsurance AG and about your rights according to data protection law.

For what purposes and on what legal basis do we process your data?

We process your personal data while complying with the EU General Data Protection Regulation (GDPR), the Federal Data Protection Act (Bundesdatenschutzgesetz BDSG) and all other relevant laws.

Gen Re Business School processes personal data (such as first name, surname, employer, address, e-mail, telephone number, date of birth if applicable, and level of subject knowledge) in order to carry out its further education and training programmes (correspondence, participant administration and process organisation).

In addition, we process your data in order to be able to confirm the achievement of further education and training (e.g. the marks attained) and to be able to create replacement documents in the event of a possible loss of certificates, diplomas and/or certificates of participation. This refers to information relating to your participation in Gen Re Business School's further education and training programs (e.g: The name of the event / course / module(s) you have participated in, as well as examination results, dates, employer and contact details).

All user activities within our online learning platform will be recorded. The number of available learning objects / documents, access statistics of documents ("clicks") and the access speed (benchmark test) will be analysed in a fully anonymised way.

We process your personal data on the basis of Article 6 paragraph 1 f) DSGVO in order to be able to offer you and your company the aforementioned service with reference to the requirements described above.

In addition, we process your personal data to fulfill legal obligations such as commercial and tax document retention obligations. The legal basis for the processing in these cases are the respective legal regulations in conjunction with Art. 6 Para. 1 c) DSGVO.

For other purposes not mentioned here we use solely anonymised data. Should we wish to process your personal data for a purpose not stated above, we will inform you beforehand within the framework of the statutory provisions.

Categories of recipients of personal data

Data processing within the Gen Re group of companies

Your personal data is in part also processed by associated companies of General Reinsurance AG. This happens as part of:

  • general IT services provided by the General Reinsurance Corporation for its subsidiary General Reinsurance AG

External service providers

We use external service providers in order to meet some of our contractual and statutory obligations:

  • IT service providers for maintenance, operation and backup of systems and applications, data restoring and data destruction;

  • Service providers for data management (storing and termination of documents);

  • Service providers for copy and print;

  • Audit service provider for carrying out internal audits and IT security audits;

Additional recipients

Furthermore it might be necessary to share your data with public authorities in order to fulfil reporting obligations:

  • Supervisory authorities

  • Chartered accountants

  • Prosecution authorities

  • Social insurance agencies

  • Hotels, Private International Travel Health Insurance Fund, Chamber of Industry and Commerce, Charterd Insurance Institute

What rights do you have in respect of your personal data?

Right to access, rectification, erasure, restriction of processing and portability

You can initiate an access request under the above mentioned contact details to obtain information on the personal data we hold and process about you. Furthermore, in certain circumstances you have the right to have your personal data rectified, erased or processed restrictively. In addition, you have the right to data portability, i.e. to receive the personal data you have provided to us in a structured, commonly used and machine readable format, and to have that personal data transmitted directly to another data controller.

Right to object to the processing

You have the right to object to processing of your personal data for direct marketing purposes.

If we process your data in order to safeguard legitimate interests you have the right to object to such processing if reasons that argue against the processing result from your particular situation.

Right to lodge a complaint

You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement.1 The following data protection agency has responsibility for us:

Right to withdraw your consent

If we process your personal data on the basis of your consent, you have the right to withdraw this consent at any time. The withdrawal of your consent might impact the further processing of your personal data in regard to the purpose. More details on the consequences of a consent withdrawal are included in the information provided to you with the consent form.

Transfer of your personal data to a third country

Should we transfer personal data about you outside of the European Economic Area (EEA), this transfer only takes place, if guarantees (e.g. an adequacy decision of the European Commission, Binding Corporate Rules, European Standard Contractual Clauses or other approved contracts) are in place that ensure an adequate level of protection. Detailed information on this and on the data protection level of recipients in third countries can be requested from the above-mentioned contacts.

Retention and deletion of your personal data

We will retain your personal data for as long as is necessary for the purpose(s) set out above, or for as long as is required by law.

Personal data that is processed for the purpose of carrying out the training courses will be stored for up to five years after completion of the training course.

Personal data collected in the course of determining the success of individual further training (e.g. results achieved, online user activities) will also be stored for ten years after completion.

We store personal data collected for the purpose of producing certificates of participation and the success of further training until the documentation and verification function of these certificates is no longer relevant to the participant and the request for a possible newly issued certificate to be sent is no longer to be expected. This point in time is reached at the presumed retirement age of 67 and thus varies depending on the age of the participants in the Gen Re Business Schools further education and training programmes.

We also store your personal data as we are legally obliged to do so. Corresponding documentation and storage obligations arise, among other things, from the German Commercial Code, the Tax Code and the Money Laundering Act (storage periods of up to ten years are legally required).
